UK Planning Reform – British Government scraps duty to co-operate
The government will soon introduce regulations allowing Local Planning Authorities (LPAs) to start preparing new-style local plans and, at the same time, abolish the current Duty to Co-operate for the existing plan-making system.
The Minister of State for Housing and Planning, Matthew Pennycook MP, has (on 27 November) written to the Planning Inspectorate to set out that government intends to revoke the Duty to Co-operate for the current plan-making system. He has also made clear that local planning authorities should continue to collaborate across their boundaries, including on unmet development needs from neighbouring area.
The Duty to Co-operate was created in 2011 to support cross-boundary collaboration after the end of regional planning. Mr Pennycook notes in his letter that it has proven difficult to apply and has caused several local plan failures, partly because any deficiencies cannot be fixed during examination.
Fergus Charlton, planning partner at national law firm Michelmores comments: “Even before the Planning and Infrastructure Bill receives Royal Assent, the government has signalled its commitment to the central plank of a plan lead system, namely planning decisions made against up-to-date local plans. Lack of cooperation with neighbouring authorities has caused Inspectors to send many plans back to development, leaving too many out-of-date plans. Government clearly wants to make rapid progress on replacement of this duty with the spatial development planning provisions of the Bill.”

A motorway service station, between junctions 32 and 33 of the M6 motorway in northwest England.
This unusual hexagonal concrete tower dates was built and opened in 1965. Located on the northbound side, The Pennine Tower originally housed an up-market restaurant and a sun deck. The bold structure was designed to resemble an air traffic control tower. It closed to the public in 1989.
